Terms of service

(Please note : this page appears under the title "Terms of Service" on our site. In order to comply with Belgian and European legislation, it constitutes our General Terms and Conditions of Sale as well as our terms of use of the site.)

 

Article 1 – Scope of Application

These general terms and conditions of sale and use (hereinafter "GTCSU") apply to all sales concluded through the website www.lensycouture.com (hereinafter the "Site"), operated by Lensy (hereinafter the "Seller"), and to any use of said Site.

Any order placed on the Site constitutes unconditional acceptance of these GTCSU, which prevail over any other document.

Article 2 – Products

The products offered for sale are those listed on the Site at the time of the order, subject to availability.

The Seller strives to ensure the accuracy of product descriptions and visuals, but cannot be held responsible for any minor differences (colors, textures, finishes).

Article 3 - Prices

Prices are displayed in euros, inclusive of all taxes (VAT included).

The Seller reserves the right to modify prices at any time, it being understood that products will be invoiced based on the rate in effect at the time of order confirmation.

Shipping costs are charged separately and indicated before the order confirmation.

Article 4 - Orders

The order becomes firm and final after payment confirmation.

The Seller reserves the right to refuse any order in the event of a dispute with the Customer, product unavailability, or an obvious pricing error.

Article 5 - Payment

Payment is made online by credit card, or any other method available at the time of the order.

Payments are secured through an approved payment provider.

Any unpaid order will be cancelled.

Article 6 - Delivery

Orders are prepared within 48 business hours from confirmation.

Delivery times vary by carrier and destination.

The Seller cannot be held responsible for delays attributable to the carrier, customs services, or cases of force majeure.

Article 7 – Right of Withdrawal

In accordance with Articles VI.47 and following of the Belgian Code of Economic Law and Directive 2011/83/EU, the Customer has a period of 14 calendar days from receipt of the products to exercise his right of withdrawal, without reason or penalty.

To exercise this right, the Customer must notify his decision to the Seller by e-mail (contact@lensycouture.com) or via the standard withdrawal form included in the annex.

The Customer must return the products at his own expense, in their original condition, unworn, unwashed, with their tags and packaging.

Article 8 - Returns and Refunds

In case of valid withdrawal:

  • Refunds to the original payment method are made exclusively in cases of product defect or error by the Seller.
  • In all other cases, a voucher of an equivalent amount will be issued.

The refund is processed within 14 days of receipt of the products or proof of their shipment.

Initial shipping costs are not refunded, unless the product is defective or an error was made in the preparation of the order.

Sale items cannot be returned or exchanged, except for lack of conformity.

Article 9 - Legal Warranty

In accordance with Articles 1649bis and following of the Belgian Civil Code, products benefit from a legal warranty of 2 years in the event of a lack of conformity existing at the time of delivery.

This warranty does not cover normal wear and tear, damage resulting from improper use or inadequate care.

Article 10 - Liability

The Seller cannot be held responsible for any indirect damages resulting from the use of the products or the inability to access them.

The responsibility of the Seller is in any case limited to the amount of the order.

Article 11 - Intellectual Property

All elements of the Site (texts, visuals, logos, trademarks, design, source code) are protected by copyright and remain the exclusive property of the Seller.

Any reproduction, distribution, or exploitation without authorization is strictly prohibited.

Article 12 - User Content and Comments

The Customer is responsible for any content published on the Site (comments, reviews, etc.) and warrants that it is not defamatory, offensive or contrary to the law.

The Seller reserves the right to remove any content deemed inappropriate.

Article 13 - Personal Data

The data collected is necessary for the processing of orders and is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the Site's Privacy Policy.

Article 14 - Applicable Law and Competent Jurisdiction

These GTCSU are governed by Belgian law.

In the event of a dispute, exclusive jurisdiction is attributed to the courts of the judicial district of the Seller's registered office, unless otherwise provided by law.

Article 15 - Amendment of Terms

The Seller reserves the right to modify these GTCSU at any time.

The applicable conditions are those in effect at the time of the order.
